IMPORTANT:

Please read these Terms and Conditions carefully before using our services. By booking a session, accessing our website, or using our services, you agree to be bound by these terms.

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client"), and Earla Tiffany Beam ("we," "us," "our," or "Service Provider"), concerning your access to and use of the earlatiffany.com website and the hypnotherapy services provided.

By accessing or using our website, booking a session, or engaging our services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using our services and must discontinue use immediately.

2. Description of Services

We provide the following complementary wellness services:

  • Clinical Hypnotherapy: A therapeutic technique that uses guided relaxation and focused attention to achieve a heightened state of awareness, allowing for positive suggestions and behavioral changes.
  • Neuro-Linguistic Programming (NLP): A communication and personal development approach focused on understanding how language and neurological processes affect behavior.
  • Timeline Therapy®: A therapeutic technique designed to release negative emotions and limiting decisions from the past.

These services are:

  • Educational and self-improvement services
  • Complementary to, not replacements for, medical or psychological treatment
  • Intended for personal growth, stress management, and behavioral modification
  • Not intended to diagnose, treat, cure, or prevent any disease or medical condition

3. Eligibility and Age Requirements

To use our services, you must:

  • Be at least 18 years of age, OR
  • Be a minor (child or adolescent) with written consent and signature from a parent or legal guardian
  • Have the legal capacity to enter into a binding agreement (or have a parent/guardian with such capacity)
  • Not be prohibited from using our services under applicable laws

Children's Services: We provide coaching and therapy services for children and adolescents. For all minor clients:

  • A parent or legal guardian must provide written consent and signature on all required agreements before services begin
  • A parent or legal guardian must be present during the initial consultation
  • Parental involvement may be required throughout the therapeutic process, as appropriate for the child's age and circumstances
  • All service agreements and consent forms must be signed by the parent or legal guardian

We reserve the right to refuse service to anyone at our sole discretion, particularly if we determine that hypnotherapy may not be suitable for your specific situation or if required agreements are not completed.

4. Required Client Agreements and Informed Consent

ALL clients, regardless of age, must sign a client agreement before receiving any services. This requirement applies to:

  • Adult Clients (18+): Must personally sign a client agreement and informed consent form
  • Minor Clients: Must have a parent or legal guardian sign a client agreement and informed consent form on their behalf

Required Documents Include:

  • Client Service Agreement: Acknowledges these Terms and Conditions, Disclaimer, and Privacy Policy
  • Informed Consent Form: Details the nature of services, potential benefits and limitations, confidentiality policies, and client rights
  • Health Information Form: Medical history, medications, and relevant health information (for appropriate service delivery)

Agreement Requirements:

  • All agreements must be signed and returned before the first session can commence
  • Services will not begin until all required documents are completed and signed
  • For minors, the parent or legal guardian must sign all documents
  • Agreements may be provided electronically or in person, as arranged

What the Agreement Confirms:

  • You have read, understood, and agree to these Terms and Conditions
  • You have read, understood, and agree to the Disclaimer
  • You have read, understood, and agree to the Privacy Policy
  • You understand the nature, benefits, and limitations of hypnotherapy, NLP, and Timeline Therapy® services
  • You consent to receive these services
  • You understand confidentiality policies and exceptions
  • You acknowledge that services are complementary and not a substitute for medical or psychological treatment

No Services Without Agreement: We will not provide any services, including initial consultations, until all required agreements are signed. If you have questions about the required agreements, please contact us before booking a session.

5. Booking and Scheduling

Sessions are scheduled through our online booking system (Calendly) or by direct arrangement. By booking a session, you agree to:

  • Provide accurate contact information
  • Arrive on time for scheduled sessions (online or in-person)
  • Be in a safe, private location for online sessions
  • Have a stable internet connection for online sessions
  • Not be under the influence of alcohol or non-prescribed drugs

We reserve the right to reschedule or cancel sessions due to emergencies, technical issues, or other unforeseen circumstances. We will provide reasonable notice when possible.

6. Payment Terms

Payment Methods: We accept payment via methods specified at the time of booking, which may include credit cards, debit cards, or other electronic payment methods.

Payment Timing:

  • Payment is due in full prior to the commencement of the first session in a package, OR
  • Payment is due at the time of booking for individual sessions, OR
  • As otherwise agreed upon in writing for payment plans

Package Pricing: Package prices are for the complete package as described. Individual sessions within a package cannot be purchased separately at package rates.

Price Changes: We reserve the right to modify our pricing at any time. Price changes will not affect sessions already booked and paid for.

Refunds: Refund policies are detailed in Section 7 (Cancellation and Refund Policy) below.

7. Cancellation and Rescheduling Policy

Client Cancellations:

  • 24+ Hours Notice: Cancellations made at least 24 hours before the scheduled session time will receive a full refund or credit toward a future session.
  • Less than 24 Hours Notice: Cancellations made less than 24 hours before the scheduled session time may be subject to a cancellation fee of up to 50% of the session cost, or forfeiture of the session from a package.
  • No-Show: Clients who fail to attend a scheduled session without prior notice will forfeit the session and may be charged the full session fee.

Provider Cancellations: If we need to cancel or reschedule a session, we will provide as much notice as possible and offer to reschedule at your convenience or provide a full refund.

Emergency Exceptions: Cancellation fees may be waived in cases of documented medical emergencies or other extenuating circumstances, at our sole discretion.

Rescheduling: Sessions may be rescheduled at no charge if requested at least 24 hours in advance, subject to availability.

8. Refund Policy

Individual Sessions: Full refunds are available for cancellations made at least 24 hours in advance. Refunds for cancellations made less than 24 hours in advance are at our discretion.

Package Purchases:

  • If you have not yet begun the package, a full refund is available within 7 days of purchase.
  • If you have begun but not completed the package, refunds will be calculated on a pro-rata basis for unused sessions, minus a 10% administrative fee.
  • No refunds are available for completed sessions within a package.
  • Packages must be completed within 12 months of purchase, unless otherwise agreed in writing.

Refund Processing: Refunds will be processed to the original payment method within 5-10 business days.

No Refunds For: Services already rendered, digital products (recordings, materials), or sessions forfeited due to no-show or late cancellation.

9. Client Responsibilities and Conduct

As a client, you agree to:

  • Provide accurate and complete information about your health, medications, mental health status, and any conditions that may affect your suitability for hypnotherapy
  • Inform us immediately of any changes in your medical or mental health status
  • Not be under the influence of alcohol or non-prescribed drugs during sessions
  • Maintain appropriate conduct during sessions
  • Respect the therapeutic relationship and boundaries
  • Not record sessions without explicit written permission
  • Not operate vehicles or machinery immediately after sessions if you feel impaired
  • Seek appropriate medical or psychological care when needed
  • Use services only for lawful purposes

We reserve the right to terminate services immediately if a client engages in inappropriate conduct, violates these Terms, or if we determine that hypnotherapy is not suitable for the client's situation.

10. Session Recording and Materials

Client Recordings: Clients are not permitted to record sessions (audio or video) without explicit written permission from the Service Provider.

Provider Recordings: We do not record sessions without your explicit written consent. If recording is desired for therapeutic purposes (e.g., creating custom hypnosis recordings), this will be discussed and agreed upon in advance.

Custom Recordings: Custom hypnosis recordings provided as part of packages are for your personal use only and may not be shared, distributed, or used for commercial purposes.

Intellectual Property: All session materials, recordings, scripts, and content remain the intellectual property of Earla Tiffany Beam and may not be reproduced or distributed without permission.

11. Intellectual Property Rights

All content on this website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Earla Tiffany Beam or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or create derivative works from our content without permission
  • Use our content for commercial purposes
  • Remove copyright or proprietary notices from materials
  • Use our name, logo, or trademarks without permission

Personal use of materials provided during sessions (e.g., custom recordings) is permitted for your own therapeutic purposes only.

12. Third-Party Services

We use third-party services to facilitate our operations, including:

  • Calendly: For scheduling and booking management
  • Payment Processors: For processing payments
  • Video Conferencing Platforms: For online sessions

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or content of third-party services.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Earla Tiffany Beam, her agents, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any conduct or content of third parties on our website or services
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through our services
  • Any decisions made or actions taken based on information provided during sessions
  • Any adverse reactions, side effects, or outcomes from hypnotherapy sessions

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Earla Tiffany Beam, her agents, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to our services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of our services caused damage to a third party.

15. Dispute Resolution

Informal Resolution: We encourage you to contact us first if you have any concerns or disputes regarding our services. We will work in good faith to resolve any issues informally.

Mediation: If informal resolution is unsuccessful, disputes may be resolved through mediation before pursuing formal legal action.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which services are provided, without regard to its conflict of law provisions.

Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the jurisdiction in which services are provided, and you hereby consent to the personal jurisdiction and venue therein.

16. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use our services will immediately cease
  • Any outstanding payments will become immediately due
  • Refunds will be handled according to our refund policy

You may discontinue use of our services at any time by providing written notice. Refunds will be handled according to our refund policy.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using our services.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our services and supersede and replace any prior agreements.
